The United States Congress created an employment-based immigration policy in 1990, allowing foreign entrepreneurs to invest in new, commercial, job-creating enterprises in exchange for expedited, lawful, permanent resident immigration status, leading to U.S. citizenship. The Immigration and Nationality Act (INA) allocates 10,000 immigrant visas (green cards) each year to qualified individuals seeking permanent residency in the U.S. on the basis of their investment in a qualified U.S. enterprise.
The first step in gaining access to the U.S. through EB5 investment is the I-526 application, the approval of which grants the investor and their family (spouse and all unmarried children under the age of 21) a two year conditional green card. The application process also requires the transfer of EB5 funds totaling $500,000 USD or $1,000,000 USD, if the business will be located in a non-target employment area.
Upon assignment of the conditional green card(s), the investor and the family may work, live or own a business anywhere in the United States. Children may attend American schools, colleges and universities. The cost of living in the United States is less than in most large industrial nations. The United States also offers many financial and educational benefits, such as public schools, healthcare, social security, and higher education. Permanent residents and U.S. passport holders may travel to the United States and most countries without the need of a visa.
